Kevin Nunn's Defence
Kevin Nunn was given bail a year before the trial. He was able to live on his own and sign in each day to the local police station. There was no further 'evidence' provided by Suffolk Police from that day up until the trial at Ipswich Crown Court in October 2006.
LACK OF FORENSIC EVIDENCE
No forensic report was seen or called for by the Defence for Dawn Walkers motor vehicle despite many witness' stating that her car was parked unusually on her drive . The prosecution had made many assumptions, one of which was that Dawn Walker had been killed, taken out of the house, brought back into the house, and then taken out again, over a 48 hour period. Again these claims were not substantiated with forensic reports - there would have been deposits of burnt skin samples, hair, and bodily fluids in the home or garden, shed or water butt.
The 1mm hair found in the laundry basket liner at Kevin Nunn's home (the liner taken out of the basket - the basket left) was said to be "similar" to Dawn Walker's. The prosection could not ascertain how long the hair had been in the liner or who it belonged to. Forensic tests stated it was cut not shaven. No Forensic evidence was found in Kevin's clothing, bedding, his house and garden, or his car, a black company owned Volkswagon Passatt. No evidence of use of any other motor vehicle or shared use of a motor vehicle during the time period.
There was no evidence from the Forensic Scientist, Helen Haworth, that the body of Dawn Walker was ever in that house. Dawn was a fit, strong young woman. The Pathologists reported there were no signs of a struggle, or defence wounds, or any injury that would have caused death.
Probably cause of death was hypothermia - if as the prosecution lead the jury to believe, it was a jealousy killing outside or near her home, how could she had died from hypothermia?
LACK OF TELECOMMUNICATIONS EVIDENCE
Telecommunications evidence produced by the prosecution was somewhat selective and sketchy as to Kevin Nunn's whereabouts the evening of 2 February 2005. He had sent a text message from his home some 10 miles away at 10.15pm to Dawn Walker. According to a witness, Kevin Nunn was supposedly in a heated argument with Dawn Walker outside her home . Kevin Nunn is 5'8" tall and left the Suffolk Golf and Leisure Club in jogging bottoms and light coloured sweat top (see video still taken from the golf club on that evening).
On the telephone log of Kevin Nunn's mobile provider, he had telephoned the police station on the Friday 4th February at 1621 hrs to get an update as he had contacted the Police Station in the morning to report her missing. He had made contact with Dawn Walker's work colleague through the switchboard of Abbeyhine Printers (Dawn Walker's place of work) ( the first time he had spoken to him ) . This man had not heard from Dawn Walker. These were the only telephone records between these two men - but this man was charged with assisting an offender and was Kevin Nunn's accomplice!
LACK OF FOOTPRINT EVIDENCE BY THE RIVER LARK
Kevin Nunn gave a statement to the police on Saturday afternoon which stated he walked along the public footpath on Thursday
3rd February 2005, the day after Dawn Walker had gone missing thinking she may have gone off jogging or for a walk. It was by the River Lark, a walk they often did together, as well as other nearby routes in and around Fornham St Martin. Six weeks prior to his arrest, Police requested that Kevin Nunn hand over the footwear used whilst out looking for Dawn Walker, he co-operated fully with all of their requests and freely gave the footwear used when out looking for her to the police.
The many prints found by Scenes of Crime showed that his footprints did not deviate from the public footpath and continued away from the alleged burn site, the footprints all went in a forward motion, there was no evidence of his footprints from the alleged burn site to the deposition site . As the prosecution claimed, he worked with an accomplice - where is the evidence of this type of footprint pattern?
No forensic evidence of Kevin Nunn's footprints deviating from the footpath alongside the River Lark - and if as the prosecution claimed he worked with an accomplice, no evidence of this type of footprint pattern brought forward to substantiate this claim. There was no sighting of Kevin Nunn alongside the public footpath by The River Lark at any time during the relevant time period.
LACK OF EVIDENCE PERTAINING TO JEALOUSY THEORY
Dawn Walker liked to remain in contact with all her ex boyfriends. Regardless of whether they had been violent or had married. One ex boyfriend had a key to Dawn Walker's house. He alleges he gave the key back in January 2005. Kevin Nunn admitted he was not happy with this man going in and out of her home. Kevin Nunn also admitted to following Dawn one evening when she was having a drink with another male. He felt stupid and silly and never did it again. Kevin Nunn was supposed to have killed Dawn Walker in a fit of jealousy - there is no evidence to substantiate this claim. Three pathologists stated Dawn Walker died from hypothermia probably due to exposure. No stab wounds, no puncture wounds, no sign of strangulation .
On reporting Dawn Walker missing, Kevin Nunn came forward with a key to her home to assist the police with entry to Dawn Walker's house on Friday afternoon. No one else knew he had the key. It later transpired there was a set of keys found by the Scenes of Crime Officers in Dawn Walker's shed - Kevin Nunn did not know this until much later when going through the photos and paperwork with his solicitor. He said in court he felt very bad about having the key cut as he had let Dawn down. There was nothing sinister about the key - he had it cut months before when Dawn Walker had asked for the keys back to give a neighbour when they went away on holiday. He admitted being insecure in the relationship. The prosecution portrayed Kevin Nunn as a jealous, possessive stalker. All of these serious personality disorders were not identified or caused concern when being assessed by two Independent Psychiatrists when enabling bail conditions to be applied.
Each Psychiatrist said Kevin Nunn did not and has not suffered from mental ill health and was NOT a danger to the public. They also concluded he did NOT have "pre morbid jealousy". This information unfortunately was not given to the jury.
